INFORMATION ON THE PROCESSING of personal data pursuant to European Regulation 679/2016 (GDPR)

IMPORTANT COMMUNICATION:

Since 25 May 2018, the European Regulation 679/2016 (GDPR) has become fully applicable, which defines the general rules for the protection of personal data. This is an important step that imposes the same rules for the processing of personal data in all countries of the European Union. Farchioni Olii S.p.A. considers the protection of personal data of individuals a fundamental value and respect is a primary objective to be guided by management.

1) RIGHTS OF DATA SUBJECTS AND PROCEDURE FOR EXERCISING

The Regulation recognizes the following rights that the interested parties may exercise against and against the owner and each co-owner.

  • Right of access: Art. 15 of the European Regulation allows you to obtain from the controller the confirmation that a data processing is being carried out or not concerning you and in this case to obtain access to these data.
  • Right of rectification: Art. 16 of the European Regulation allows you to obtain from the controller the correction of inaccurate personal data that concern you without undue delay. In view of the purpose of processing, the data subject has the right to have incomplete personal data supplemented by providing a supplementary statement.
  • Right of cancellation: Art. 17 of the European Regulation allows you to obtain from the controller the deletion of personal data concerning you without undue delay if one of the reasons provided exists by the norm.
  • Right of limitation: Art. 18 of the European Regulation allows you to obtain from the controller the limitation of processing when one of the scenarios provided by the rule.
  • Right of opposition: Art. 21 of the European Regulation allows you to oppose at any time, for reasons related to your particular situation, processing of personal data concerning the Member State concerned pursuant to Article 6, paragraph 1, points e) or f), including profiling on the basis of those provisions.
  • Right to portability: Art. 20 of the European Regulation allows you to receive in a structured format, commonly used and machine-readable personal data concerning you provided to a controller and has the right to transmit such data to another controller of the unimpeded processing by the controller to whom they have been provided under the conditions laid down in the standard.
  • Right to withdraw consent: Art. 7 of the European Regulation allows you to revoke your consent at any time. The withdrawal of consent does not affect the lawfulness of the processing based on consent before the withdrawal.
  • Right of complaint: Art. 77 of the European Regulation, if you consider that the processing concerning you violates the regulation, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State where you habitually reside, work or where the alleged infringement took place.

2. PRIVACY POLICY

The processing of personal data communicated by visitors to FARCHIONI OLII S.P.A. through this site will be carried out in accordance with the following modalities. FARCHIONI OLII S.P.A. is the Data Controller of personal data communicated to it by visitors to this website. These data will be used by FARCHIONI OLII S.P.A. for the purposes for which the subject to whom these data refer has given his consent. FARCHIONI OLII S.P.A. through this site collects anonymous data and information (type of browser, geographical location, date and time) that it also processes using cookies, to obtain the best management and optimization of the site, as well as for statistical purposes and to collect more information about its products and their consumption. This information may reside on servers located in Italy or on central servers of FARCHIONI OLII S.P.A. located abroad, but will not be communicated by the owner or its Managers to third parties or used to contact site visitors unless they request or consent. The communication of personal data relating to a child must be made by a parent or person exercising legal authority over the child.

1. DATA CONTROLLER

2. CO-OWNERSHIP – THIRD PARTY CONTRACTS
In the case of co-ownership, the owner shall ensure that compliance with the following principles is ensured through the co-ownership agreement. In the event that processing activities of personal data are entrusted to third parties, the holder shall ensure that compliance with the following principles is ensured through the service contract.

3. ORGANIZATION
The data controller organizes the resources and processing of personal data so that they comply with the requirements of the GDPR and national sector legislation. In particular:
a) Inside

  • The privacy organisation shall reflect the operational organisation, and the responsibilities shall be consistent with the operational tasks, powers and authority attached to them.
  • Persons to whom significant tasks and responsibilities are assigned (considering the number and categories of personal data, risks to the rights and freedoms of natural persons) shall be selected, identified and commissioned on the basis of objective criteria that define the knowledge, skills and experience needs of the entity. In the absence of qualifications, the assessment requirements and weights are pre-defined.
  • Those who process the data act under the direct authority of the owner or a controller appointed by him. Staff shall be properly trained and informed according to a continuing training programme which takes into account the different needs in relation to the various roles.
  • The data controller directs and supervises all those who process personal data on his behalf.

b) Outside

  • The subjects entrusted with processing personal data are selected and identified and commissioned on the basis of a prior process, transparent, ensuring the objectivity of the choice; the supplier has the necessary skills and professionalism; the possession by the provider of sufficient guarantees to put in place appropriate technical and organizational measures so that the processing meets the requirements of the GDPR and ensures protection of the rights of the data subject.
  • The relationships with third parties who process data on behalf of the owner are always formalized in writing. The contract in question complies with the minimum requirements of art. 28 GDPR.
  • The controller directs and supervises all those to whom he delegates processing activities.

5. THE CULTURE OF PRIVACY
For Farchioni Olii S.p.A. the ability to protect personal data is not only a legal obligation but rather a preferential requirement, a competitive asset. In line with the accountability perspective required by GDPR, the Company addresses the compliance of its personal data processing with the GDPR with a risk-oriented approach and their treatment. Respect for the rights, freedoms and data of individuals is an underogable ethical imperative that guides all activities that it carries out.

6. LEGALITY
Farchioni Olii S.p.A. only processes personal data based on one of the legal bases referred to in art. 6 GDPR (consent, fulfilment of contractual obligations, vital interests of the person concerned or third parties, legal obligations to which the holder is subject, public interest or exercise of public authority, overriding legitimate interest of the data controller or third parties to whom the data is disclosed).

The Company processes particular personal data, (i.e., data capable of revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as processing genetic data, biometric data intended to uniquely identify a natural person, data relating to the health or sexual life or sexual orientation of the person), only if one of the cases provided for in art. 9.2 GDPR. The Company processes personal data related to criminal convictions and offences or related security measures, only on one of the legal bases referred to in article 6.1 GDPR, and only under the control of the public authority, or whether the processing is authorised by Union or Member State law providing appropriate guarantees for the rights and freedoms of data subjects.

7. CORRECTNESS
The Company processes personal data exclusively for specific, explicit and legitimate purposes, without any wrongdoing or deception of the data subjects, strictly within the limits of the legal bases that legitimize their processing.

8. TRANSPARENCY
The Company shall take appropriate measures to provide the data subject with all the information referred to in Articles 13 and 14 and communications referred to in Articles 15 to 22 and Article 34 relating to treatment in concise form, The European Commission, DG XIII, has published a report on the European Union’s research and development policy in the field of education. In particular, the Company for each processing it carries out informs the data subject how personal data are collected, used, accessed or otherwise processed and the extent to which personal data is or will be processed. Information and communications relating to the processing of such personal data shall be easily accessible and understandable

9. PURPOSE LIMITATION
Farchioni Olii S.p.A. processes personal data for specific, explicit and legitimate purposes, ensuring that the processing is not incompatible with these purposes.

Farchioni Olii S.p.A. processes personal data that is appropriate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

Farchioni Olii S.p.A. stores personal data in a form that allows the identification of interested parties for a period not exceeding the achievement of the purposes for which they are treaties.

13. INTEGRITY AND CONFIDENTIALITY
Farchioni Olii S.p.A. processes personal data in a way that ensures adequate security of the data, including protection, through appropriate technical and organizational measures, unauthorised or unlawful processing and accidental loss, destruction or damage.

14. DATA PROTECTION BY DESIGN AND BY DEFAULT
Farchioni Olii S.p.A. adopts the methodological approach to any project, based on which the protection of personal data must be evaluated from the design stage. For any project, Therefore, both structural and conceptual data protection should be considered from the moment of its design and personal data protection solutions should be provided. The Company implements appropriate technical and organizational measures to ensure that they are processed, by default, only the personal data necessary for each specific purpose of processing; in particular the technical and organizational measures put in place are intended to ensure that – by default – the data is processed according to the specific purposes of processing.

15. COMPULSORY
Failure to comply with the principles contained in this document, as well as with directives, instructions, requests, orders that may be issued by the Company for the protection of personal data and compliance with applicable legislation constitutes serious non-compliance.

This document is approved by the Board of Directors and prepared by the Owner who will keep it updated and distributed.
